Marijuana can cause a haze and not just from the smoke - many employers and HR professionals are having a hard time seeing straight as they try to create workplace policies related to marijuana, plus alcohol and other drugs.

 

More people failed drug tests last year than ever before, according to a recent article in the Seattle Times, but many employers are deciding to drop the tests rather than risk losing employees in a tight labor market. This might be okay for office workers, but it’s not such an easy choice in higher-risk industries.

 

And, while strict drug policies, backed by consistent testing, may be the right thing to do for safety, they can open your company up to a world of legal and regulatory pain if not done right. It’s easy for marijuana policies to run afoul of ADA, FMLA, HIPAA, and more, especially if medical marijuana is involved.
